TERMS AND CONDITIONS OF THE EMSLA

These terms and conditions form the agreement between the artist and the EMSLA that governs the entry of the Eutick Memorial Still Life Award (EMSLA) Throughout this article EMSLA will refer both to the actual art prize competition and the Project Gallery representatives, as the context dictates.

By submitting a completed entry form the artist agrees to these terms and conditions and assures that all information provided by the artist in the entry form and in the course of the prize is true and correct. Once the Artist has completed and submitted the entry form and such form has been received by EMSLA, it will be considered to be a Legal Document.

EMSLA may amend these terms and conditions and the entry form at any time.

EMSLA has absolute discretion in deciding whether or not an artist or an artwork has satisfied the terms and conditions for entry into the EMSLA.

EMSLA reserves the right to revoke the award of any prize money (and any associated privileges) to a finalist, and may grant it to another finalist, if the finalist declares false information in the entry form or during the course of the prize, or fails to comply with their obligations under these terms and conditions.

The decisions of EMSLA and the Judges are final and no challenges will be permitted.

2019 EMSLA TERMS AND CONDITIONS

PRIZE

1. Winner of the EMSLA: $20,000.

ELIGIBLE ARTISTS

The submitting Artist must be an Australian citizen and is aged 18 years or over.

Immediate families of the Prize Judges are not eligible to enter the EMSLA.

Artists may enter a maximum of two artworks into the EMSLA.

The Artist must assure that the artwork is original and does not infringe the copyright, moral rights or other rights of any third party.

ELIGIBLE ARTWORK(S)

The Artwork must have been undertaken and completed by the artist in the last 12 months.

MEDIUM

The EMSLA only accepts original paintings in any painting medium such as watercolour, acrylic and oil. To qualify for adjudication the work must be substantially painted and can incorporate other mediums such as drawing (pencil, pastel, charcoal, etc.), printmaking and collage. Photography and sculpture are specifically excluded. All work entered must be the original work of the artist. The Artist must provide details of the medium used in the Artwork on the Entry form. If there is any uncertainty as to the medium used, contact the EMSLA at info@emsla.com.au.

Artists may submit up to two paintings completed within the last 12 months, with a maximum size of 240 cm x 240 cm, including framing.

Painting and packaging material must bear the artist’s name, address, and painting title.

All works must be packaged in a heavy-duty cardboard box appropriate for shipping and protection.

Artwork must be fitted with D rings rendering it suitable for wall hanging.

ENTRY FEE

For entry, the artist must submit an online entry form only, accompanied by the entry fee of $38 (inc GST). Entry fees are non-refundable.

Payment of the Entry Fee/s must be made via the website using the Artist’s name.

ENTERING THE EMSLA

Entries must be submitted by 5pm (AEDT) Friday 27th September 2019.

All entries are to be made online via the EMSLA website and each must include the following:

1. A completed entry form for the artwork submitted (maximum of two per artist).
2. Payment of the $38 entry fee.
3. One high resolution (maximum 5 Mb) image of the Artwork in digital format (eg. jpeg). The image must be a true and accurate representation of the completed Artwork entered.

No incomplete or late entry will be processed and artworks associated with incomplete or late entries will not be eligible or given consideration of entry.

PRESELECTION

An independent preselection panel will review the artwork images and select the finalists for the exhibition and final judging.

EMSLA reserves the right to revoke an offer to an artist to be a finalist if the artwork differs in any material way from the artwork image submitted by the artist.

The panels’ decisions are final and no correspondence will be entered into.

FINALIST SELECTION AND JUDGING

The successful exhibiting artists will be notified by Friday, 4th October 2019.

The finalists’ Artworks will be hung in the Project Contemporary Artspace Gallery from Friday, 8th of November 2019 (opening night), until Sunday, 1st December 2019.

PREPARING THE ARTWORK FOR DELIVERY - FINALISTS ONLY

The Artwork must be:

1. Suitably framed for handling. A stretched canvas is considered a suitable frame.
2. Clearly marked on the back with the Artist’s name, address and the title of the Artwork.
3. Accompanied by clear instructions for its installation if it is a multi-panelled artwork (diptych or triptych).
4. NOT be wet when submitted.
5. Be fitted with 25mm length D Rings on the back at 100mm from top of artwork for ease of hanging.
6. NOT have hooks or wires as they can damage other artworks (the gallery has its’ own hanging system for the D Rings)
7. The artwork must be packed in heavy duty cardboard to withstand travel and have the Artist’s name, address, title of the artwork attached to the packaging material to enable the Gallery to re-pack the artwork at the conclusion of the exhibition.
8. A layer of bubble wrap covering the artwork will not be accepted.

DELIVERY OF ARTWORK

All Finalist Artworks must be delivered as follows:

1.    Delivered to the EMSLA collection location at PHEBRA PTY LTD, 19 Orion Rd, Lane Cove West NSW 2066, between 9.00 am to 4.00 pm, Monday to Friday. Any works received after these times will not be accepted. No weekend deliveries will be accepted.

If Artwork is to be delivered by courier the above delivery times must be adhered to. It is the Artist’s responsibility to pay for couriers to collect their work.

RETURN OF WORKS

Returned works must be collected from PHEBRA strictly by the 19th December 2019.

Unsold works will be returned to PHEBRA for collection by artists or couriers at close of exhibition period.

If the artist is collecting from Phebra, first send an email to info@emsla.com.au before collecting.

If collected by courier, it is important that you provide them with these details:

-    Full name of artist
-    Address of Artist

EXHIBITION OF ARTWORK

Artworks will be hung at the sole discretion of the EMSLA and no discussion will be entered into with the finalists.

ANNOUNCING OF WINNER

The winner will be announced at the EMSLA 2019 Exhibition Opening on Friday, 8 November 2019.

SALE OF ARTWORK

All Artworks must be for sale.

The price specified by the Artist must include 20% commission (10% commission to Project Gallery + 10% GST = 20%).

The EMSLA will sell the Artwork at the price specified on the Entry Form. The EMSLA is not responsible for miscalculations by the Artist and/or their Agent. The amount cannot be changed once the entry form has been submitted.

The EMSLA will not be liable for agent’s fees and/or agent commissions on sales.

Artists will be informed of sales at the conclusion of the exhibition.

Payment for sold artwork will be processed and transferred to the artist’s chosen bank account within 8 weeks of the exhibition conclusion. The artist will be notified.

COLLECTION OF ARTWORK

All unsold Artworks must be collected on conclusion of the exhibition.

On conclusion of the exhibition the EMSLA will re-pack the unsold Artworks for collection in the original packing.

Artwork can be collected from the Project Gallery
or
PHEBRA between the 1st of December 2019 and 19th December 2019, between 9am and 4pm.

Artists sending a Courier to either point must have their artwork picked up at the specified times.

Forward and return freight and insurances are the responsibility of the artist. Australia Post is not available for return of works. The EMSLA accepts no liability for loss or damage during transit from the artist to Phebra, and from Phebra returning to the artist.

PROMOTION

The Artist retains the intellectual property of the Artwork.

The Artist must agree to EMSLA using the image for the purpose of:

• Promoting, marketing, educational, broadcasting, advertising or otherwise publicising any aspect of the EMSLA.
• Any display or art exhibitions containing Artworks entered in the EMSLA.
• The production of electronic or print media, such as, but not limited to, exhibition catalogues featuring images of Artworks entered into the EMSLA.

INSURANCE

Each Artist is responsible for maintaining their own insurance.

Neither EMSLA, Phebra, nor the Project Artspace Gallery will be responsible for any loss or damage to the artwork, whether in storage, transport or handling.
EMSLA will not be liable for damages or costs associated with courier mishandling or damage caused by a third party.
